3.  What are cookies?

Cookies are strings of text that websites (so-called “publishers” or “first parties”) visited by the user or different websites or web servers (so-called “third parties”) install and store, directly in the case of publishers and indirectly, through the latter, in the case of “third parties” - in the user’s device.

The terminals referred to are, for example, a computer, a tablet, a smartphone, or any other device capable of storing information. 

The software for browsing the Internet and operating these devices, e.g. browsers, can store cookies and then send them back to the websites that generated them the next time the same user visits the site, keeping a record of the user's previous interaction with one or more websites.

The information encoded in cookies may include personal data, such as an IP address, username, unique identifier or email address, but may also contain non-personal data, such as language settings or information about the type of device a person is using to browse the website.

Cookies can therefore perform important and diverse functions, including session tracking, storing information about specific configurations of users who access the server, facilitating the fruition of online content, etc. They can, for instance, be used to keep track of the items in an online shopping cart or the information used to fill in a digital form.

The same result can also be achieved using other tools (which can be divided into so-called “active identifiers”, such as cookies, and “passive identifiers”, the latter being used merely for observation purposes), which enable processing operations like those mentioned above.

“Passive” tools include fingerprinting, i.e. that technique which makes it possible to identify the device used by the user by collecting all or some of the information relating to the specific configuration of the device itself adopted by the person concerned. This technique can be used to achieve the same profiling purposes also aimed at displaying personalised behavioural advertising and analysing and monitoring the behaviour of website visitors, i.e. to conform the type and methods of the services rendered to the behaviour of the user subject to previous observation. 

 

3.1 Classification of cookies:

Cookies and other tracking tools can be classified according to their duration (divided between session and permanent cookies), or they can be classified as first-party cookies installed directly by the website the user is visiting, and third-party cookies, installed by a domain other than the one the user is visiting.

Technical cookies These are used for the sole purpose of “the transmission of a communication over an electronic communications network, or to the extent strictly necessary for the provider of a service by the information company explicitly requested by the contracting party or user to provide such service” (cf. art. 122, para. 1 of the Privacy Code);
Profiling cookies These are used to link specific actions or recurring behavioural patterns in the use of the functions offered to specific identified or identifiable subjects, in order to group the various profiles within homogeneous clusters of different sizes, so that the controller can, among other things, modulate the provision of the service in an increasingly personalised manner beyond what is strictly necessary for the provision of the service, and send targeted advertising messages, i.e. in line with the preferences expressed by the user when browsing the web.

4.  Legal basis and Purpose of the process

The cookies described are used to enable the website to function properly. As part of browsing activities, information such as internet protocol (IP) address, browser used, parameters of the device used to access the website, internet provider, time references relating to the visit (from followed by time), web page of origin of the visitor (referral) and exit, number of clicks, may be collected. This information may be used exclusively for statistical purposes without further interconnection with other data. 

If the user voluntarily fills in the forms present on the website, supplying their data, these will be processed in order to fulfil pre-contractual measures, enabling the Controller to contact the user again. It should be noted that, at the bottom of each form, is the relevant information on the processing of personal data.

Data processing carried out using technical cookies does not require consent; on the contrary, the use of profiling cookies will take place only and exclusively on the basis of the specific consent of the user to be expressed using the appropriate functions of the banner. 9. Provision of data

The processing of personal data by the Controller via the installation of technical and analytical cookies is necessary to allow the user to correctly browse the website. If profiling cookies are used, the data processed via these cookies will only be processed with the user's consent. 

As regards the spontaneous provision of data by users who decide to fill in any forms on the website, processing is carried out in accordance with the pertinent privacy policy, which the user has read. If the processing requires consent, this is requested from the user before proceeding with the processing.
